Adviser Competence & Standards

The UK Employee Advice Centre is building a written competence and supervision framework for independent workplace assistance.

1. Statutory Certification under s.203 ERA 1996

Under section 203(3A)(c) of the Employment Rights Act 1996, an advice-centre worker advising on a settlement agreement must be authorised and certified by the Centre as competent to advise on the terms and effect of the agreement. The Centre will not issue its own statutory settlement-agreement certificates until that written authorisation, certification and insurance framework is complete.

2. Professional Indemnity Insurance

Professional indemnity insurance is being arranged. Any statutory certificate work must be covered by insurance for claims arising in consequence of the advice, as required by s.203(3)(d) ERA 1996.

3. Professional Supervision

Case files, research notes and settlement calculations will be reviewed under a documented supervision process before statutory certificate work begins.
